MR appeals against CoA orders

Former President and incumbent Parliamentarian Mahinda Rajapaksa yesterday (4), filed an appeal with the Supreme Court against the 3 December Court of Appeal Interim Order, which restrained him from holding the position of Prime Minister and 49 MPs from holding Cabinet portfolios.

 

The appeal was filed, on behalf of Rajapaksa, by Attorney-at-Law Sanath Wijewardene. The petition states that the Interim Order issued by the Court of Appeal against the Prime Minister and his Cabinet are unconstitutional and that the Court of Appeal has no authority to issue such orders.

 

Therefore, the appellants requested the Supreme Court to issue an order declaring the Interim Orders issued by the Court of Appeal as unlawful and issue an Interim Order preventing the implementation of the Court of Appeal orders until the hearing on the appeal is concluded by the Supreme Court.

 

The 122 MPs, led by United National Party Leader MP Ranil Wickremesinghe, who had signed the Writ of Quo Warranto petition, against Rajapaksa holding office as the Prime Minister, have been named as respondents in the appeal.
